Terms of Service

These Terms of Service (“Terms”) form a binding agreement between you and the operators of Bulwark (“Bulwark,” “we,” “us,” or “our”) concerning your access to and use of the Bulwark Discord application and any related websites or support channels we make available (collectively, the “Service”).

By inviting Bulwark to a Discord server, configuring the Service, or otherwise using the Service, you agree to these Terms and to our Privacy Policy. If you are accepting these Terms on behalf of a server, organisation, or other entity, you represent that you have authority to bind that entity. If you do not agree, do not use the Service.

Bulwark provides tools intended to help Discord communities detect coordinated scam floods, contain compromised accounts, preserve related evidence, and alert moderators. Features, interfaces, and documentation may change as we develop and maintain the Service.

We may modify, suspend, or discontinue all or any part of the Service at any time, with or without notice, including to address security, legal, operational, or platform requirements. We have no obligation to provide any particular feature indefinitely.

You may use the Service only if you can form a binding contract under applicable law and only in compliance with these Terms, Discord’s terms, and all applicable laws. You are responsible for ensuring that you have the rights and permissions necessary to add Bulwark to a Discord server and to authorise the processing described in our Privacy Policy for that server.

The Service operates on Discord and depends on Discord’s APIs, infrastructure, and policies. Your use of Discord remains subject to Discord’s Terms of Service, Privacy Policy, and Community Guidelines. We are not responsible for Discord’s acts or omissions, API changes, rate limits, outages, or enforcement decisions, and we do not control Discord’s platform.

You agree that you will:

• configure and operate Bulwark in a manner appropriate for your server, including permissions, roles, and moderation workflows;
• use detection, containment, evidence, and related features solely for legitimate moderation, security, and community-safety purposes;
• ensure that persons with access to Bulwark management commands understand that automated actions may affect legitimate members and should be reviewed promptly;
• limit management access to trusted operators and safeguard any credentials or privileged Discord permissions associated with the Service; and
• remain responsible for final moderation decisions, including reversing or escalating actions taken by the Service.

You may not, and may not permit others to:

• use the Service to harass, unlawfully surveil, discriminate against, or otherwise harm individuals, or for any purpose other than legitimate server moderation and security;
• attempt to probe, scan, reverse engineer (except to the extent such restriction is prohibited by law), interfere with, or disrupt the Service, Discord, or related systems;
• scrape, resell, publish, or misuse incident evidence or Service data except as reasonably necessary for your server’s security and moderation functions;
• circumvent rate limits, access controls, or other technical restrictions, or use the Service in a manner that imposes unreasonable load on our systems; or
• misrepresent your identity, your authority, or your relationship with Bulwark.

The Service uses automated matching and related logic to identify suspected scam-flood patterns. No automated system is perfect. False positives and false negatives may occur. You acknowledge that Bulwark is an assistive moderation tool and not a guarantee that every scam, compromise, or harmful message will be detected or stopped. You remain solely responsible for reviewing incidents and for any moderation action taken in your server.

You retain whatever rights you have in content originating from your Discord server. You grant Bulwark a non-exclusive, worldwide, royalty-free licence to host, process, transmit, and display such content solely as needed to provide and secure the Service for your server, including detection, containment, evidence preservation, and operator-facing alerts. We do not claim ownership of your server content.

The Service, including software, branding, documentation, and related materials, is owned by Bulwark or its licensors and is protected by intellectual property laws. These Terms do not transfer any ownership interest to you. You may not copy, modify, distribute, sell, or create derivative works from the Service except as expressly permitted by us in writing or by applicable law.

We endeavour to keep the Service available, but we do not guarantee uninterrupted or error-free operation. Availability may be affected by maintenance, Discord platform conditions, network issues, configuration errors, insufficient bot permissions, or events beyond our reasonable control. The Service is provided on an “as available” basis.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WITHOUT LIMITING THE FOREGOING, WE DO NOT WARRANT THAT THE SERVICE WILL DETECT OR PREVENT EVERY SCAM, SECURITY INCIDENT, OR UNAUTHORISED MESSAGE, OR THAT IT WILL MEET YOUR SPECIFIC REQUIREMENTS.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BULWARK AND ITS OPERATORS, AFFILIATES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM AND (B) ZERO IF THE SERVICE WAS PROVIDED WITHOUT CHARGE. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN THOSE JURISDICTIONS, OUR LIABILITY IS LIMITED TO THE FULLEST EXTENT PERMITTED BY LAW.

You will defend, indemnify, and hold harmless Bulwark and its operators from and against any claims, losses, liabilities, damages, costs, and expenses (including reasonable legal fees) arising out of or related to your use of the Service, your Discord server content or moderation decisions, your breach of these Terms, or your violation of applicable law or third-party rights.

You may stop using the Service at any time by removing Bulwark from your Discord server and ceasing all use. We may suspend or terminate your access to the Service immediately if you breach these Terms, if required for security or legal compliance, if Discord restricts the application, or if we discontinue the Service. Provisions that by their nature should survive termination (including ownership, disclaimers, limitations of liability, and indemnity) will survive.

We may revise these Terms from time to time. The “Last updated” date indicates the effective date of the current version. If we make material changes, we will provide notice as we deem appropriate under the circumstances. Your continued use of the Service after the revised Terms become effective constitutes acceptance of those Terms, except where applicable law requires a different process.

These Terms constitute the entire agreement between you and us regarding the Service and supersede prior agreements on the same subject. If any provision is held unenforceable, the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our prior written consent; we may assign them in connection with a reorganisation, merger, or sale of assets. Nothing in these Terms creates a partnership, joint venture, or employment relationship.
